Apple decides to pay $9.75M settlement over alleged Powerbeats 2 ‘design defect’

A lawsuit was filed against Apple in 2017, due to false advertising of the Powerbeats 2 headphones. According to the categories, the company advertised its headphones as water and sweat resistant, while they are designed to last.

However, the plaintiffs state that the above does not apply, with the headphones not holding their charge after minimal use.

The litigation continued to this day, where Apple decided to accept the settlement and pay $9.75 million. The company continues to deny allegations of a Powerbeats 2 design error but has agreed to the settlement to avoid further litigation. Although the lawsuit also concerned the Powerbeats 3, this settlement only concerns the 2014 Powerbeats 2.To continue to involve in this matter users who live in America and have purchased Powerbeats 2 before August 7 can fill out the form by November 20 to check if they are eligible for a refund.

The amount that each buyer will receive depends on the number of people who will apply, with the theoretical maximum amount of $189, according to court documents.
